1. Introduction

This Privacy Policy explains how ESS India ("we", "our", or "us") collects, uses, shares, and protects your information when you use the ESS Tracker mobile application (the "App"), package name com.essindia.tracker on Google Play.

ESS Tracker is an enterprise workforce management and attendance solution. It is provided to employees and contractors of organisations (each, your "Employer") that use ESS Tracker services from ESS India. You can only sign in with credentials issued by your Employer.

Please read this policy carefully. By using the App you confirm that you have read and understood it. Our Terms & Conditions also apply.

2. Location Data Collection

Specifically, location data is used for:

• Verifying that you are present at designated work sites, client locations, or geofenced duty boundaries.
• Automatically logging attendance check-ins and check-outs.
• Recording route progress during official working hours for field employees.

Location is collected only during your active shift or duty hours as set by your Employer. It is never sold and is not used for advertising.

Your control: you can withdraw location permission at any time in Android Settings → Apps → ESS Tracker → Permissions → Location. If you do, automatic attendance verification will not work, and you should follow your Employer's alternative attendance procedure.

We use the information only for the App's operational purposes:

• Workforce Management: Recording shift attendance, duty logs, and location check-ins.
• Service Functionality: Syncing offline logs to our servers when connectivity returns.
• Security & Integrity: Verifying identity and detecting fake or mock location use.
• Reliability: Using battery and network status to avoid sync interruptions during shifts.
• Communication: Sending shift reminders and important notices.

5. Data Sharing & Third-Party Services

We do not sell, rent, or trade your personal or location data. We share data only as follows:

• Your Employer: Location logs, attendance records, and duty updates are made available to your Employer's authorised administrators for attendance, payroll, and workforce management.
• Service providers who process data for us:
  • Google Firebase Cloud Messaging: delivers push notifications (see the Google Privacy Policy).
  • Expo services: used to build and deliver the App and, where enabled, app updates. These services may process technical information such as device details and IP address.
• Legal reasons: Where required by law, court order, or a government authority, or to protect rights and safety.

6. Your Employer's Role

In most cases your Employer decides why attendance and location data is collected, and ESS India processes that data on the Employer's behalf to operate the App. Questions about how your Employer uses your data (for example for payroll or workplace decisions) should be directed to your Employer.

7. Data Security & Storage

We use administrative, technical, and organisational measures to protect your data, including:

• Encryption of data in transit using HTTPS/TLS.
• Storage of sign-in tokens in the device's secure credential storage.
• Storage of offline data in the App's private storage, which other apps cannot access.
• Access controls limiting data visibility to authorised administrators.

Your data is stored on secure servers operated by or for ESS India. If data is processed outside India, we apply appropriate safeguards as required by law. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

8. Data Retention & Account Deletion

We keep your data while your account is active and for the period your Employer requires for business records and legal compliance. After that, we delete or anonymise it unless the law requires us to keep it.

9. Your Rights & Choices

Subject to applicable law (including India's Digital Personal Data Protection Act, 2023), you may:

• Ask what personal data we hold about you and request a copy.
• Ask us to correct inaccurate or incomplete data.
• Ask us to delete your data (see Section 8).
• Withdraw location or notification permissions at any time in your device settings.
• Raise a grievance with our Grievance Officer (see Section 13).

10. Children's Privacy

The App is for adult employees and contractors only and is not directed to anyone under 18. We do not knowingly collect personal information from children. If we learn that we have done so, we will delete it promptly.

11. Android Permissions Requested

• ACCESS_FINE_LOCATION: precise GPS location during active shifts.
• ACCESS_COARSE_LOCATION: approximate, network-based location when GPS is weak.
• ACCESS_BACKGROUND_LOCATION: location verification while the App is in the background during shift hours.
• FOREGROUND_SERVICE_LOCATION: runs the location service with a visible notification, as Android requires.
• POST_NOTIFICATIONS: shift check-in notifications and duty updates.
• INTERNET and ACCESS_NETWORK_STATE: syncing data and detecting offline status.

12. Changes to This Privacy Policy

We may update this policy from time to time. The updated version will be posted on this page with a new "Last Updated" date. For significant changes, we will also notify you through the App or your Employer.
